In the epic battle of Man Vs. TSA who will win? (Insert scary sound effects here.)

In December of 2010, Aaron Tobey was arrested by the TSA and the Richmond International Airport Security after stripping down to his underwear with a portion of the Fourth Amendment written on his chest. Although the charges of his arrest were eventually dropped, Tobey proceeded to sue the TSA and the airport.

A whole year and a half (and a bunch of legal proceedings) later, Aaron Tobey won his civil suit against the TSA and the airport. While the TSA didn’t seem to be all that humbled by the case, the Richmond International Airport Security underwent a special training course on the First and Fourth Amendments. Every history teacher’s dream, right?

What on Earth is the Fourth Amendment you ask? Well, the Fourth Amendment actually concerns the right of the people to be secure against unreasonable searches and seizures. It also includes the requirement of a warrant to be judicially sanctioned and supported by probable cause. The Fourth Amendment was adopted as a result of abuse of the writ of assistance (a very general search warrant) in the American Revolution.

Now that I’ve given you a little history lesson that you probably didn’t want, you’re totally prepared to fight the TSA with the Fourth Amendment right? And no, I am not supporting physical violence here.

So just remember…We the People of the United States, in Order to form a more perfect Union…No wait, that’s the preamble. Dang, what was that Fourth Amendment again?
